Terms of Service

The rules of the road. Short version: don't be reckless, and we'll get along great.

1. Acceptance of Terms

By downloading, installing, or using TunnerForge software ("the Software") or purchasing tuning services ("Services"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Software or Services.

2. Software License

TunnerForge is provided as licensed software with the following grant of license:

  • You may install and use the Software on any number of computers you personally own.
  • You may not redistribute, resell, sublicense, or reverse-engineer the Software.
  • You may not use the Software to defeat emissions control systems for on-road vehicles where prohibited by law.
  • The Software is provided "as is" without warranty of any kind, express or implied.

3. Tuning Services

Our tuning services are subject to the following terms:

  • Customers are responsible for providing accurate information about their motorcycle's modifications.
  • Incorrect or incomplete information may result in suboptimal tuning results.
  • ECU shipping is at the customer's risk — we recommend insured shipping with tracking.
  • We guarantee our maps to be free of defects that would cause engine damage under normal use. If a defect is found, we will correct it free of charge.
  • We do not guarantee specific horsepower or torque figures, as results vary by bike condition, fuel quality, altitude, and other factors beyond our control.
  • Refunds for tuning services are handled on a case-by-case basis. Contact us within 30 days if you are unsatisfied.

4. Acceptable Use

You agree not to:

  • Use the Software to create maps that intentionally damage engines or ECUs.
  • Use the Software to circumvent legally mandated safety or emissions systems on street-legal vehicles (track-only and off-road use excepted).
  • Distribute maps created with the Software that are known to be dangerous or defective.
  • Use the Services or Software in connection with any illegal activity.

5. Limitation of Liability

Important — please read carefully:

  • ECU tuning inherently modifies critical engine parameters. Improper tuning can cause engine damage, void warranties, and create unsafe riding conditions.
  • TunnerForge, its creators, and its employees shall not be held liable for any damages arising from the use of the Software or Services, including but not limited to engine damage, property damage, personal injury, or death.
  • You assume all risk associated with modifying your motorcycle's ECU.
  • Our maximum liability for any claim related to the Software or Services shall not exceed the amount you paid us in the 12 months preceding the claim.

6. Intellectual Property

  • The TunnerForge name, logo, and Software are the intellectual property of TunnerForge.
  • ECU calibration files you create with the Software are your intellectual property. We claim no ownership over user-created maps.
  • Base maps provided in our map library are licensed for your personal use only and may not be resold or redistributed.

7. Termination

We reserve the right to terminate or suspend access to the Software (cloud features) and Services for violations of these terms. Upon termination, your right to use the cloud-connected features of the Software will cease immediately. Locally installed Software will continue to function for offline use.

8. Governing Law

These Terms are governed by the laws of the State of Texas, United States of America. Any disputes shall be resolved in the courts of Travis County, Texas.

9. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email and in-app notice at least 30 days in advance. Continued use after changes take effect constitutes acceptance.
